For business users registered before that date, they shall apply from 1. 11. 2026. For other users registered before 3. 10. 2026, they shall apply 15 days after a notice of the change is first displayed to them on the website after logging in. They supersede the Terms of Use dated 13. 5. 2024 and the Advertising Terms dated 20. 3. 2021. For users registered before 3. 10. 2026, the previous Terms of Use and the Advertising Terms shall apply until these Terms take effect for them.
1. Who We Are and the Purpose of BAJK.SI
The bajk.si website, including all its subdomains and the mobile application (hereinafter referred to as “BAJK.SI” or the “website”), is operated by PTECH, Luka Pleško s.p., Celovška cesta 136, 1000 Ljubljana, company registration number 8024634000, tax number 79269885. The Provider is not liable for VAT. Contact: info@bajk.si. This address also serves as the Provider’s single electronic point of contact for users and competent authorities under the Digital Services Regulation; communication is available in Slovenian and English.
BAJK.SI is an online classifieds platform for bicycles, cycling equipment, components and related services. The Provider supplies the technical platform on which users post and search advertisements and communicate with one another.
The Provider is not a party to transactions between users. It is not a seller, intermediary, agent or guarantor and does not verify users’ identities or the existence, ownership or condition of items.
2. To Whom These Terms Apply
- All visitors and users. These Terms apply to every visitor and registered user of the website and mobile application. By using the website, the user confirms that they have read and accepted these Terms; by registering, they expressly accept them. Acceptance of these Terms is a prerequisite for registration. Upon registration, the user is also informed of the Privacy Policy.
- Age. The user must be at least 15 years old. Younger persons may use the website only with the consent of a parent or guardian, who shall be responsible for their conduct.
- Business users. In addition to these Terms, the specific provisions of Section 9 shall also apply to them. A business user is not a consumer; statutory provisions intended for consumers shall not apply to business users.
- Changes to the service. The Provider may modify, restrict or discontinue website functionalities due to changes in legislation or requirements imposed by an authority, for security or technical reasons, to prevent misuse, to adapt to technology or third-party services, to introduce or improve functionalities, or to discontinue functionalities that can no longer be maintained. Any such change shall be free of charge for the user. The Provider shall notify business users by e-mail, and other registered users by e-mail or by a notice displayed on the website to the logged-in user, at least 15 days in advance of any change that affects use to more than a negligible extent; a user who does not agree to such a change may close their account free of charge within 30 days, while Section 7 shall apply to paid services.
3. User Account
Registration is required to post advertisements, send messages, save searches and purchase services. Advertisements may be viewed and favourite advertisements saved without an account.
3.1 Registration and Login
- Registration details. The user shall enter a display name, e-mail address and location. The account becomes active upon the first successful login using the code received by the user at their e-mail address.
- Refusal of registration. The provider may refuse or defer registration without stating a reason, particularly where automated security checks indicate a risk of misuse.
- Passwordless login. The user shall log in using a one-time code or a link sent to their e-mail address. The browser may remain logged in for a maximum of 30 days.
- Responsibility for access. The user shall exercise reasonable care in safeguarding access to their e-mail inbox and shall notify the provider without delay of any suspected misuse of the account. The user shall be liable for the actions of an unauthorised person to the extent that the user enabled such actions intentionally or by failing to take reasonable security measures; the user shall not be liable for access resulting from a security deficiency attributable to the provider.
- One account and accurate information. Each user may have one account. The information entered must be accurate and kept up to date; the user must not impersonate another person or company. The provider may at any time require verification of identity or contact details and may restrict use of the account until such verification has been completed.
- No transfer. An account may not be transferred, sold or made available for use by a third party. Creating a new account after a previous account has been blocked or terminated constitutes a breach of these Terms.
3.2 Deletion, Termination and Blocking of an Account
- Deletion by the user. The user may delete their account at any time in the profile settings. Upon deletion, the user's advertisements, favourite advertisements, saved searches and personal profile data shall be removed. Further details are provided in the Privacy Policy.
- Termination by the provider. The provider may terminate a private user's account at any time without stating a reason by giving notice by e-mail at least 7 days in advance. Termination of a business account is governed by Section 9.
- Immediate blocking. Without a notice period, the provider may temporarily or permanently disable an account and remove any content associated with it if the user breaches these Terms or applicable law; if there is a reasonable suspicion of fraud, misuse, a threat to other users or to website security; if the account was created automatically or for bulk posting; if the user fails to respond to requests for verification of information; or if required by a competent authority. The same shall apply to business accounts.
- Statement of reasons and objection. No later than when the measure is implemented, the provider shall notify the user thereof by e-mail and provide a clear statement of reasons specifying: the measure imposed and its duration, the facts and circumstances underlying the decision, whether automated means were used, the contractual or legal basis, and the available options for objection and legal redress. A statement of reasons is not required solely in the cases permitted under Article 17 of the Digital Services Regulation: in respect of deceptive high-volume commercial content (unsolicited commercial communications, automatically created accounts) and measures taken pursuant to an order issued by a competent authority. The user may object to the measure at info@bajk.si; the provider shall consider the objection diligently and within a reasonable period. The decision following consideration of the objection shall be final within the internal procedure; this shall not limit the right to seek judicial redress.
- Paid services. Where an account is terminated due to a breach, the provider shall retain payment for the portion of the service performed up to termination and shall refund the unused portion, unless it is set off against a claim for damages incurred by the provider as a result of the breach. Where the provider terminates the account without cause, a proportionate part of the payment corresponding to the unused period of the paid service shall be refunded; the user shall have no other claims. This shall not limit the consumer's statutory rights.
4. Posting Advertisements
4.1 How Posting Works
- Free of charge for private users. The Provider may introduce limits on the number of advertisements, posting frequency or categories at any time, particularly to prevent abuse, and may introduce or modify paid services.
- Duration of 90 days. As a rule, an advertisement is posted for 90 days. The Provider does not guarantee that the advertisement will remain posted for the entire period and may change its duration. Three days before expiry, the user receives a reminder; the advertisement may be extended via the link in the reminder or in the My Advertisements section. An expired advertisement remains in the account until the user deletes it or the Provider removes the expired content.
- Correct category. The advertisement must be placed in the lowest-level (final) category applicable to the item. The Provider may move the advertisement to the appropriate category.
- Draft. A draft advertisement that is not posted within 60 days is automatically deleted.
- Management. The user may edit, pause, deactivate, extend or delete advertisements via the dashboard. Once the item has been sold, the user must remove the advertisement without delay.
- No guarantees. The Provider does not guarantee any number of views, enquiries or sales, the advertisement’s position in search results, or its display in search engines and on social media.
4.2 Content Rules
By posting an advertisement, the user warrants and undertakes that:
- Subject matter and accuracy. The advertisement relates to cycling; all content is true, complete and not misleading, including the price, condition, origin and characteristics of the item.
- One item, one advertisement. The user must post one advertisement for each item, except when selling a set. Duplicate, repetitive or repeatedly reposted advertisements for the same item are not permitted.
- Own photographs. Photographs must depict the actual item and must not be catalogue images; an exception applies to new products offered by business users.
- Lawful origin. The user has the right to dispose of the item; the item is not stolen, counterfeit, seized or otherwise of unlawful origin. In the case of bicycles, the user must provide the serial number or proof of purchase at the Provider’s request.
- Permitted content. The user must not advertise goods or services whose sale or advertising is prohibited by law and must not post content that is offensive, discriminatory, violent, misleading or infringes third-party rights.
- Commercial sales only through a business account. Regular sales, the sale of new products, and activities involving retail, servicing, rental or brokerage are permitted only through a business account.
- Copyright. The text and visual materials are the user’s own copyrighted works, or the user has obtained permission from the rights holder to use them; the materials must not depict persons without their consent.
- No redirection. The advertisement must not contain advertising for other websites, services or businesses, links to other classified advertising platforms, contact details in photographs, or content intended to redirect users away from the website.
- Language. The advertisement must be written in Slovenian or in one of the languages supported by the website.
4.3 Review, Editing and Use of Content
- Review before posting. The Provider reviews advertisements manually and through automated checks. The first advertisement posted by a new or less trusted user and advertisements with an unusual price may be posted only after review. The Provider is not obliged to post an advertisement; if posting is refused due to non-compliance with these Terms or applicable law, the Provider will notify the user and provide the reasons specified in Section 3.2.
- Editing and removal. The Provider may edit an advertisement at any time (correct the category, title, description or a price stated in the wrong currency, remove or crop photographs, or add a watermark), hide it from search results, reduce its visibility, temporarily withdraw it or delete it if, in the Provider’s assessment, it violates these Terms or harms the user experience or the reputation of the website. If an advertisement is deleted, withdrawn or has its visibility reduced due to a violation, the Provider will notify the user by e-mail and provide the reasons specified in Section 3.2.
- Automated translations. The website is available in Slovenian, English, German, Italian, Croatian, French, Hungarian and Czech. The title and description of an advertisement are translated automatically by machine; the translation is labelled as such, and visitors may view the original. An automated translation is provided for information purposes and may be inaccurate; the user’s original text is authoritative. The user is responsible for the accuracy and lawfulness of the original text, but not for any error generated by the translation tool where the original text was correct. Upon notification, the Provider will correct or regenerate any manifestly incorrect translation.
- Social media posts. The user agrees that the Provider may publish selected advertisements (photographs, title, brand, year, size, price and a link to the advertisement) on its social media profiles (Facebook, Instagram) and through other promotional channels. Advertisements are selected automatically; the seller’s name and contact details are not published. Posts already published may remain published after the advertisement has been deleted; the user may object to such processing in accordance with the procedure set out in the Privacy Policy.
- Right to use content. The user grants the Provider a non-exclusive, royalty-free and territorially unrestricted right to reproduce, store, technically adapt, translate, display and make available to the public the content of the advertisement (text and photographs) on the website, in the mobile application, in e-mail notifications, in online search engines and in the Provider’s promotional posts, and to use it for statistics, analysis and service development. To the extent necessary, the Provider may transfer these rights to its processors, hosting providers, search engines and operators of promotional channels. Artificial intelligence tools are used for translation, import, technical preparation and the selection of advertisements for promotion. This right applies for the entire period during which the advertisement is posted. After the advertisement has been deleted, the right continues to apply only to backup copies and the security archive for the retention periods specified in the Privacy Policy, to the defence of legal claims, to anonymised statistics and to promotional posts already published, until the user objects to them. This does not restrict the user’s rights concerning personal data under the Privacy Policy. The user waives any claims for remuneration on this basis.
5. Messages Between Users
Registered users may send messages to other users through a listing or from a profile. There is one conversation between any two users.
- Purpose. Messages are intended exclusively for communications concerning listings on BAJK.SI. Sending unsolicited advertisements, offers for other services, misleading offers, links to fraudulent payment or delivery services, harassment, and the collection of users' contact details are prohibited.
- New senders. A new user's first conversation and conversations initiated by users with a low trust rating may be held for approval; the recipient will not see them until they have been approved. A rejected conversation will be deleted without notice to the sender.
- Limits. Limits apply to the number of messages and new recipients within a specified period, particularly for new accounts; the provider may modify these limits.
- Attachments. Images or PDFs, up to 3 files of 4 MB each, are accessible only to the participants in the conversation. The provider may remove attachments that violate these Terms.
- Notifications. The user will receive an e-mail notification of the first unread message in a conversation and reminders until the message has been read. These notifications form part of the service and cannot be disabled.
- Reporting a conversation. A user may report a conversation to the provider. By submitting a report, the user agrees that the provider may receive the full transcript of the conversation and the details of both participants for the purpose of assessing potential abuse.
- Deletion and retention. A user may delete their copy of a conversation; the other participant will retain their copy. Once both participants have deleted the conversation, it will be permanently removed after 60 days. The provider may remove messages that violate these Terms and does not guarantee the permanent retention or delivery of messages and notifications.
- Blocked users. A user who has been blocked by the provider may no longer send messages; their messages will no longer be displayed to the other participants.
6. Other Features and Notifications
- Favourite listings. A user may save listings and publicly share the list. If the price of a saved listing decreases, the user will receive an e-mail notification; notifications may be disabled in the user's profile. Guests may save up to 20 listings in their browser; a guest's list will be deleted after 30 days of inactivity.
- Saved searches. A registered user may save up to 20 searches and receive notifications of new listings immediately or daily. Each notification contains an unsubscribe link.
- Mobile application. Where available, these Terms also apply to the mobile application. The application may send push notifications; the user may manage them in the device settings.
- Public profile. The user's display name, location, year of registration, avatar, description, and website are publicly visible together with the user's listings. A private user's telephone number and e-mail address are visible only if the user enables this option in the settings.
- System messages and news. The user agrees that the provider may send by e-mail any messages necessary for the operation of the service (login codes and notifications concerning listings, messages, payments, expiry, amendments to the Terms, and security incidents). The provider sends notifications concerning website updates and services only to users who selected this option upon registration or in the settings; the user may withdraw consent at any time using the link in each message.
- Changes to features. The provider may modify, restrict, or discontinue individual features for the reasons and in accordance with the procedure set out in Section 2. The provider may act without prior notice only where an urgent security measure is required or pursuant to a binding request from a competent authority; users will be notified subsequently.
7. Paid services: promoted listings (Premium listings)
- What promotion means. A user may promote a listing for 7, 15 or 30 days. A promoted listing (Premium listing) is labelled as such and displayed ahead of other listings in search results, on the home page and among recommended listings. The provider determines the exact placement and manner of display and may change them. Promotion does not guarantee any specific number of views, enquiries or sales.
- Prices. Prices are published in the price list before purchase and are final. The provider is not registered for VAT; therefore, VAT is not charged. The provider may change its prices and offering at any time; services already paid for are subject to the price applicable at the time of purchase.
- Extension and transfer. A further purchase for an already promoted listing extends the existing promotion. The user may transfer an active promotion to another of their listings free of charge. A promoted listing shall not expire earlier than 30 days after the promotion ends.
- Business packages. Business users may purchase a promotion package (multiple slots for 30 days) with automatic monthly renewal, which they may disable at any time in the dashboard; renewal is charged three days before expiry. Unused slots are neither carried over nor refunded.
- Payment. Payment is processed through the payment service provider Mollie B.V. using the payment methods supported by Mollie. The provider does not store payment card details and is not liable for the operation of the payment service provider. The service is activated once payment has been confirmed.
- Invoice. For each payment, the provider issues an electronic invoice, which the user receives by e-mail and may download from their account. Invoices are fiscally certified. An invoice for a private user is issued to the “end customer”; a business user confirms the company details before purchase. Subsequent amendments to an invoice are not possible.
- Right of withdrawal. Listing promotion and promotion packages commence immediately upon payment. By placing an order, the consumer expressly requests that performance of the service begin before the expiry of the 14-day withdrawal period. If the consumer withdraws from the contract before the service has been fully performed, the consumer shall pay a proportionate part of the price for the period during which the listing was promoted, and the remaining amount shall be refunded. Once the service has been fully performed, i.e. upon expiry of the paid promotion period, the right of withdrawal ceases (Article 135 of ZVPot-1 (Slovenian Consumer Protection Act)). The consumer shall communicate their withdrawal by means of an unequivocal statement sent to info@bajk.si or by post to the provider's address; the consumer may use the model withdrawal form annexed to ZVPot-1. The refund shall be received no later than 14 days after withdrawal and shall be made using the same payment method used for the original transaction. The order confirmation and invoice are sent by e-mail.
- Refunds and conformity of the service. Except in the event of withdrawal under the preceding point, payments are non-refundable unless otherwise required by law. If the user deletes or pauses the listing, or sells the item, during the promotion period, the unused time shall not be refunded. If the provider removes the listing or terminates the account due to the user's breach of these terms and conditions, it shall not refund payment for the part of the service already performed and may set off the unused portion against any loss incurred as a result of the breach. If, for reasons attributable to the provider, the listing was not displayed as promoted, the provider shall extend the promotion free of charge by the period during which it was not displayed as such; this shall not restrict the consumer's statutory rights arising from a lack of conformity of the digital service.
8. Third-party advertising
The website displays Google AdSense advertisements and sponsored advertisements from businesses. The provider is not liable for the content of third-party advertisements or the websites to which they link.
Banner advertisements. Banner advertising is available to businesses. The minimum order is 10.000 impressions; one creative is permitted per 10.000 impressions (JPG, PNG or HTML5, no more than 240 kB, one link). The advertiser must deliver the materials at least 5 days before publication. The advertiser is responsible for the content of the banner; the provider may refuse or discontinue publication without stating reasons. The invoice is issued when publication begins and is payable within 14 days. The number of impressions recorded by the provider shall be authoritative.
9. Business Users
- Eligibility for a business account. Legal entities and sole proprietors selling bicycles, equipment or services as part of a registered business activity. Commercial advertisements are permitted only through a business account. The provider may disable an account which, in the provider’s assessment, is conducting commercial activity without business registration, or convert it into a business account.
- Registration. The user enters the business name, tax number, address, contact person, telephone number and e-mail address; the information is verified against the public register of taxable persons. The provider may approve or reject the registration at its sole discretion without stating a reason. Upon first signing in, the business user confirms the company information and these Terms. Changes to company information take effect upon confirmation by the provider.
- Public information. The company name, address and contact e-mail address are publicly displayed alongside advertisements and on the profile. A telephone number is public only if the business user enters it in the public profile; the contact telephone number provided in the business registration is used only for communication with the provider and is not publicly displayed.
- Access to data. For the duration of the account, the business user has access through the dashboard to their profile data, their advertisements, conversations in which they participate, invoices and the statistics displayed by each individual feature. The provider does not provide an application programming interface, bulk exports or access to other users’ data. For the purposes of operating, safeguarding, analysing and developing the service, the provider has access to the data entered by the business user and to technical, payment and statistical data generated through use of the service; following termination of the account, such data is retained for the periods specified in the Privacy Policy. Data is disclosed to third parties only in the circumstances set out in the Privacy Policy.
- Plans. The current standard plan is free of charge and permits up to 50 simultaneously published advertisements, a button linking to the online store alongside an advertisement, and automatic renewal of advertisements for as long as the plan remains active. The scope, prices and terms of plans are determined by the provider and may be changed by giving at least 15 days’ prior notice by e-mail; the business user may cancel the plan within that period. A shorter notice period applies only where the change is required by law or for an urgent security reason. Upon the expiry, amendment or discontinuation of a plan, advertisements exceeding the permitted quantity are deactivated.
- Synchronised catalogue. The synchronised catalogue is in a trial (beta) phase and is free of charge. The provider grants access to individual business users at its own discretion and independently of the plan; it may refuse a request for access or for connecting a store without giving reasons. A business user with access may connect their online store. By automatically scanning the store and using artificial intelligence, the provider creates and updates advertisements from the store’s products, including photographs. The business user warrants that they have the right to use the store content and that they are the owner or authorised administrator of the domain, and is responsible for the accuracy of advertisements created in this manner, which they may edit or disconnect at any time. The provider may modify, merge, move or remove imported advertisements and does not warrant the completeness or accuracy of the import or its uninterrupted operation. The provider may change or discontinue the feature during the trial; it will notify business users of its discontinuation by e-mail at least 15 days in advance. The provider may withdraw access from an individual business user with a statement of reasons. When the feature or the access ends, synchronisation stops; advertisements already published remain until they are removed by the user or the provider.
- Liability towards customers. The business user is responsible for ensuring that their offering complies with consumer protection, price labelling and warranty regulations, and shall indemnify the provider against all related claims by customers and authorities.
- Restriction and termination of an account. The provider may limit the visibility of advertisements associated with a business account, restrict the account or temporarily disable it if the advertisements or the user’s conduct breach these Terms, harm the user experience or the reputation of the website, or if the user is in arrears with payments; the provider shall notify the user accordingly, giving the reasons referred to in Section 3.2. The provider shall give at least 30 days’ prior notice of termination of a business account, stating the reasons. The account may be terminated without notice where required by law or a decision of a competent authority, in the event of repeated breaches of these Terms, or for urgent reasons (fraud, abuse, security). For paid plans, the provider shall refund the proportionate part of the payment for the unused period only where termination is unrelated to a breach.
- Ranking of advertisements. The default »Recommended« ranking displays featured (paid) advertisements first in random order, followed by the remaining advertisements according to the date of publication or renewal, with advertisements from private and business users alternating in a ratio of approximately 2 : 1. Under the »By popularity« ranking, the determining factors are the number of times advertisements have been saved and viewed. Under all ranking methods, including ranking by price or date, featured advertisements are displayed before other advertisements. Ranking is also influenced by relevance to the search query, category and filters. Payment affects ranking solely through featuring as set out in Section 7; no other payments are accepted for higher placement.
- Payment terms. Invoices for paid plans are issued at the beginning of the period; the payment term is 14 days unless otherwise specified. In the event of late payment, statutory default interest shall accrue; the provider may suspend the publication of advertisements until payment is made.
10. Content Notifications and Cooperation with Authorities
- Notifications. The provider is not obliged to monitor user content. It shall remove illegal content or content that breaches these Terms when it becomes aware of it. A notification may be submitted using the reporting button alongside an advertisement or conversation, or to info@bajk.si. It should include a sufficiently substantiated explanation of why the content is alleged to be illegal or contrary to these Terms, a link to the content or other information enabling its unambiguous identification, and the notifier’s name and e-mail address if the notifier wishes to receive confirmation of receipt and notice of the decision. By submitting the notification, the notifier confirms their good-faith belief that the information and allegations contained therein are accurate and complete. The provider shall, without undue delay, confirm receipt to a notifier who has provided an e-mail address and, following its decision, inform the notifier of the action taken and the available means of appeal.
- Disclosure of data. The provider may disclose data concerning the user, advertisements and messages to the police, courts, inspection authorities and other competent authorities at their request, and to an injured party where permitted by law, without notifying the user.
- Automated security checks. To prevent fraud, the provider uses trust scoring, IP address verification, browser fingerprinting and blocklists, and may restrict use of the website on the basis thereof.
11. Provider's Liability
- Transactions between users. The Provider does not warrant the accuracy of advertisements, the identity, solvency, honesty or lawfulness of users' conduct, or the existence, quality, safety or ownership of items. Each transaction is concluded exclusively between the users and at their own risk; advice on safe trading is available on the website. The Provider shall not be liable for any damage arising from transactions between users, even if the advertisement was promoted or reviewed.
- User content. The Provider shall be liable for such content only to the extent prescribed for hosting providers by legislation governing information society services.
- Availability. The website is provided as is and as available. The Provider does not warrant the continuous, uninterrupted and error-free availability of the website, application, notifications, translations, imports or stored data and may suspend operation at any time for maintenance, upgrades or security reasons.
- Exclusion of damages. The Provider shall not be liable for damage resulting from interruptions, loss of data, errors in automated translations or imports, unauthorised access to an account, the actions of third parties (payment provider, social networks, hosting provider, artificial intelligence providers) or force majeure, where the damage is not the result of its breach of contract or failure to exercise due care, nor shall it be liable for indirect damage, loss of profit or loss of business.
- Limitation of liability. Where liability cannot be excluded, it shall be limited to the amount paid by the user to the Provider during the 12 months preceding the event or, in the case of free use, to 50 EUR. Nothing in these Terms excludes or limits liability for wilful misconduct or gross negligence, death or personal injury, breach of mandatory rules on consumer protection and the conformity of digital services, personal data protection, or any other liability that cannot be excluded or limited by law.
- Indemnification of the Provider. The user shall indemnify the Provider for damage and reasonable costs, including legal representation costs, incurred as a result of claims by third parties or authorities arising from the user's breach of these Terms or applicable law.
12. Intellectual Property and Use of Data
- Provider's property. The name BAJK.SI, the logo, design, software, the Provider's texts and the collection of advertisements are the property of the Provider and are protected as copyright works and a database.
- Prohibited use. Without the Provider's written permission, copying, automated collection (scraping), extraction, republication and use of data from the website in other systems, for training artificial intelligence models or for competitive purposes are prohibited. Personal use and indexing by general-purpose search engines are permitted. The Provider may technically block the infringer's access and claim damages.
- User content. Rights to the content of advertisements remain with the user, subject to the grant of the right of use under point 4.3.
13. Personal Data Protection and Cookies
The processing of personal data and the use of cookies are governed by the Privacy Policy, which forms an integral part of these Terms. The website is public: information entered by the user in an advertisement or public profile is accessible to all visitors, search engines and other automated systems, over which the Provider has no control.
14. Amendments to the Terms
The Provider may amend these Terms due to changes in legislation or a decision by a competent authority, for security or technical reasons, to prevent misuse, due to changes in third-party services, the introduction or modification of functionality, or a change in the business model, provided that the amendment is proportionate to the reason for it. Amendments shall not have retroactive effect. Business users shall be notified of amendments by e-mail, and other registered users by e-mail or by a notice displayed on the website to the logged-in user, at least 15 days before they take effect; business users shall be given a longer period where reasonably necessary for technical or commercial adaptation. Editorial corrections and adjustments to legislation that do not affect users' rights shall take effect upon publication.
A user who does not agree to the amendments may delete their account before they take effect. Continued use after the amendments take effect constitutes acceptance thereof. The version currently in force shall always be published on this page together with its effective date.
15. Final Provisions
- Governing law and jurisdiction. These Terms shall be governed by the law of the Republic of Slovenia. The courts in Ljubljana shall have jurisdiction over disputes; statutory rules on jurisdiction shall apply to consumers.
- Resolution of consumer disputes. The Provider does not recognise any provider of out-of-court consumer dispute resolution services as competent to resolve disputes that a consumer may initiate in accordance with the law governing out-of-court resolution of consumer disputes.
- Transfer. The Provider may transfer the rights and obligations arising from these Terms to a legal successor or another person that assumes operation of the website, provided that the transferee assumes all of the Provider's obligations and the transfer does not reduce the user's guarantees. Users shall be notified of the transfer in advance by e-mail; a consumer who does not agree to the transfer may delete their account free of charge before the transfer takes effect.
- Severability and non-waiver. If the Provider does not exercise an individual right, this shall not constitute a waiver thereof. If any provision is invalid, the remaining provisions shall remain in force; the invalid provision shall be replaced by a valid provision that most closely reflects its intended purpose.
- Language. The Terms are drawn up in Slovenian; in the event of any discrepancy with translations, the Slovenian text shall prevail.
- Complaints. The user may submit a complaint, a claim concerning the non-conformity of a paid service or another grievance to info@bajk.si or by post to the Provider's address, specifying the account, advertisement or order concerned and describing the claim. The Provider shall acknowledge receipt by e-mail and provide a substantive response without undue delay. This procedure does not limit the right of withdrawal, statutory warranty claims, the right to lodge a report with the competent authority or the right to judicial protection.
- Contact. Questions and reports: info@bajk.si.
